General terms and conditions


Prices

The agreed prices are net prices from Glattbrugg, excluding 7.6 % VAT, excluding transportation. Up to the complete payment a reservation of proprietary rights - which can be entered in the reservation of proprietary rights register at any time on the part of the vendor exists on all delivered products. Prices are subject to change without notice.

Conditions of payment

As far as no other agreements were made, bills have to be payed within 30 days from date of invoice strictly net.

Default

The buyer or orderer defaults with the expiration of the payment deadline. The interest for default owed from this moment on is charged according to usual bank interest rates for blank credits, however, it lies at least 4% over the respective discount rate of the Swiss National Bank.

Terms of delivery

As far as products are not available from stock, respectively if a pre-financing was agreed with the buyer, we try hard to keep our carefully calculated terms of delivery. However we cannot assume legal guarantee. This is valid particularly in the case of force majeure or strikes. A liability for damages due to delay in delivery is expressly declined.

Liability

The use of the products and their use for a certain purpose are exclusively up to the buyer and is his/her own responsibility. In no case are we liable for damages, which arise directly or indirectly through inappropriate use, possible troubles or operational failure. In particular we assume no liability for consequential damages, like loss of profit, claims for compensation of a third party or damages at recorded data.

Warranty

Principally we give 12 months of guarantee from invoicing date on all products. Should, in spite of careful final inspection of the complete system, a construction, material or work error which affects the proper functioning of the system considerably, we do the reparation free of charge. We reserve the right to exchange faulty parts or to replace the delivery completely.

Our guarantees presuppose that:
  • the system is used (stored, transported, connected) according to instructions (cp. operating manual, details affixed to the device, other accompanying-documents) at any time
  • the system was not opened arbitrarily or by not authorized third persons; changed, expanded, repaired or otherwise influenced inappropriately in its configuration (Software, firmware and hardware)
  • the system is brought or sent to PIC Systems AG, together with the receipt signed by the vender and with the delivery note which has the pur-chase date on it, at one’s own expense

If not all guarantee conditions met, PIC Systems AG reserves the right not to perform the guarantee service or to perform it only against the full charge of the costs.

Provided that the service is necessary or demanded by the customer, possible travelling expenses of a service technician are always at the expense of the customer.

The guarantee does not cover any damages which were caused by faultiness of this product directly or indirectly (e.g. data loss).

In the case of guarantee-replacement sent by post the transport costs go at the expense of the buyer. For express deliveries a surcharge of CHF 25.00 is charged.

In the case of software deliveries PIC Systems AG acts as an agent of a licence contract between the software producer and the licensee. Only the regulations of such a licence contract are valid. Any kind of warranty through PIC Systems AG is impossible.

PIC Systems AG is liable exclusively for careful carrying out of the service. Further claims as well as liability for the consequences are excluded.

On material that wears out quickly (tapes, floppy disks, printer's ink bands, CD-ROMs, etc.) no guarantee claim exists.

If, in the case of assertion of guarantee claims, it is detected that there is no defect at all, the customer is charged for all expenditures.

Offers

If no period of validity is indicated, our offers are valid during 60 days.

Export

The reexport of the product is forbidden according to the export obligation to the section for import and export. This obligation is passed on to the consumer (recipient) of the goods and in turn has to be transferred again in case of further passing on of the good.

Credit limit
Following credit limits are valid: Private persons CHF 5'000.00, companies max. CHF 30'000.00.

Tariffs

The minimum order value is CHF 30.00. For deliveries by express mail a surcharge of CHF 25.00 is invoiced.

Place of jurisdiction

Swiss law is valid. The place of jurisdiction is the place of residence of PIC Systems AG.
